Sabah JP's want to be recognised as second class magistrates


 

Here is my open email to the President of MAJAPS. Read my post yesterday to better understand this email to Datuk Seri Dr. Clarence B. Malakun (Photo above).

Dear Datuk Seri Dr. Clarence Bongkos Malakun,

I read with interest an article in the daily Express as follows:

Majaps wants powers of JPs to be restored

Published on: Sunday, August 16, 2020 on the Daily Express, Sabah.

Here are some extracts:

“We are trying to get the federal ministry of law to give a circular directing all federal government departments in Sabah to recognise the signature of JPs.

“If that cannot be done, then maybe it will have to be done in the Parliament to enhance the JPs’ powers in Sabah,” said Majaps President Datuk Seri Dr Clarence Bongkos Malakun

“Actually we want Sabah JPs’ signatures to be recognised…the RTD no longer recognises our signatures. It is embarrassing for us to be made JPs but can’t do anything,” he said.

Malakun added that the powers of JPs in the peninsula were quite clear.

“We want actually to be recognised as a second class magistrate,” he said.

 

I remember the several emails I had sent to you in 2017. It was about the integrity of your JP Dr. Muthusamy Palanisamy. You had brushed my complaint aside saying that it is personal and you said, ‘Please therefore kindly refrain from involving the Sabah JP Council in your personal battle with the Lions Club / Datuk Dr. Muthusamy, J.P.’

I believe you would have read in the Daily Express that the Lions Club of Kota Kinabalu Host was de-registered on 28.6.2018.

The club was reinstated only on 2.7.2019 by instruction of the Minister of Home Affairs based on misleading information in letters to the minister by Mr. John S F Ho who was authorized by the club members including JP Dr. Muthusamy and JP Joseph Chai.

I am now writing again to complain about JP Dr. Muthu as well as JP Joseph Chai.

Both the above JP’s together with 60 other members, according to affidavits filed in court on 2.11.2018 by Mr. John Ho Sui Fah and Mr. Francis Liew of Lions Club of Kota Kinabalu Host against the Registrar of Societies, had authorized the duo to lodge the affidavits.

In the affidavits there were many false statements including a letter to the Minister of Home Affairs, who is our current PM, which stated the following:

‘Not in the letter but upon enquiry, Mr. Mahar of ROS indicated the PPC should not have bank accounts. The PPC does not have bank accounts; all bank accounts are in the name of KK Host; a few PPC members are cheque signatories to certain bank accounts with mandate from KK Host Board of Directors; payment from these accounts were prior approved at Board meetings and financial statements of these bank accounts were presented to KK Host members at Members’ meetings.’

Subsequent to the above extract from the letter dated 28.6.2018 to the Minister of Home Affairs there were minutes of Board Meetings that proves that there were bank accounts operated by the PP Council that I had complained to you in 2017.

I have copied extracts of the 3rd BOD’s meetings for 2017/2018 where only two bank accounts were tabled. All BOD’s meetings prior to the 3rd BOD’s meeting only tabled 2 bank accounts.

I have also copied extracts of the 4th and 7th BOD’s meetings where the Treasurer’s reports show all the 5 bank accounts including the 3 secret bank accounts + a fixed deposit account that were never presented to the BOD’s until then.

 

The president during this year was Ms.Betty Epin.

 

My question to you is how was the money in the 3 bank accounts utilised over more than 10 years?

 

Who authorized these payments?

 

I remind you of the money used from these accounts for purchase of air conditioners for the club building and the renovation works to the building.

Extract of Treasurer’s Report of the 3rd BOD’s meeting

 

Item 7 – Treasurer’s Report

 

7.1 PP Joseph Chai reported on behalf of Treasurer who was outstation.

 

As of end of August, 2017, the balance of Administrative Account was RM 8,093.77 and that of Project Account was RM 808.64

Note: All minutes of meeting during my year 2015/2016 as Director of the club and previous years up until the 4th BOD meeting for year 2018/2019 (see below) only 2 bank accounts were presented to the directors.

7. Treasurer’s Report

 

7.1 Club Treasurer Ln Jessie Goh reported that as of end September, 2017, the balance of Club’s Administrative Account was RM 4108.43 and that of Project Account was RM948.24

 

7.2 PP Council Treasurer, PP Joseph Chai reported as follows: -

 

A) As of end of September, 2017, KK Host Special Purpose Account was Rm 25725.97;

 

b) Project Account was Rm 19,270.59

 

c) Admin (Premises) Account was Rm763.19

 

d) Fixed Deposit was Rm 69,214.00

7. Treasurer’s Report

 

7.1 President reported on behalf of club treasurer, Ln Jessie Goh.

 

As of end of December,2017, the balances were as follows: -

 

a)Club’s Administrative account – Rm15,327.53

 

b)Project Account – Rm74.64

 

7.2 PPC Treasurer, PP Joseph Chai reported that at the end of December, 2017, the balances were as follows: -

 

a. Special Purpose Account at Alliance Bank Rm 17,023.53

 

b. Admin Account (Premises) at Hong Leong Bank Rm372.61

 

c. Project Account (Asrama) Rm 24,673.63

 

d. Fixed Deposit account Rm 69,213.65

 

Note: Most of the members are unaware of the Past Presidents Council’s account. Perhaps my Face book friend, Datuk Dr. Muthusamy (JP) who is one of the PP council members could explain who started these accounts and for what purpose and why they were not made known to other members.

 

Datuk Dr. Malakun, I am not exacting personal revenge as stated by you in your email to me attached below. I am reporting to you about two JP’s who have authorized two members of the Lion’s Club to write to the Minister of Home Affairs to mislead him into believing that there were no secret bank accounts. This is over and above what I had complained to you in 2017.

I believe you should keep your house in order before asking for powers of JP’s to be restored. JP’s  reputation for integrity is paramount.

I would be grateful for a response from you which I would include in my affidavit to be filed in court to take legal action against the club for misappropriation of funds and for perjury committed in affidavits filed in court against the ROS.
