Grants received by Lions Club of Kota Kinabalu Host



On January 12th 2018 Francis Liew had responded to the newspaper report on “Club gets show cause from RoS” dated 11.1.2018.One of his statements is as follows:

The funds for our Rural Water Projects and the Hostel for needy students come from our joint project partners, an overseas Lions Club and from Lions Club International.
“For all these projects, all funds shortages or excesses are for the account of our club” he (Francis Liew) said.

Better to be a Lion for one day than a sheep all your life



A friend shared my post and his friend made some comments which I have copied here and give my response so that my friends may be enlightened.

Audited accounts of the club will be presented to member at an AGM and the members if satisfied can approve it. Alternatively, it will be rejected. Misappropriation is a criminal matter which must be reported to the police by members. It is not within the ROS jurisdiction to interfere how the auditing of the account is conducted so long as the members had adopted the audited accounts.

Lions Club- Interest/Investment of Public Funds



As at the end of 2017, The Lions Club of Kota Kinabalu Host had a fixed deposit of about RM70,000 which is from excess project funds accumulated over the years.

It was disclosed by Past President Joseph Chai at the 8th BOD’s meeting that the intention is to build this amount to RM100,000 and interests received from the investment is to be used for  administrative purposes. (I have mentioned earlier that this disclosure was not recorded in the minutes.)

Is Lions Club International a Franchisor






BOD I suspected that there were bank accounts not disclosed to the BOD’s as well as to members of my Lions club - Lions Club of Kota Kinabalu Host.

I wrote an email to all members asking them if there were bank accounts not disclosed to the BOD’s.


When I did not get any response from my club members I decided to write to the District Governor and then to LCI.

Infringement of Article 7 of the Societies Act




The newspaper report (refer yesterday's post) also said, “the RoS letter only stated that the club had infringed Article 7 relating to non-compliance of rules in the appointment of club officials during the AGM ….”

Our experts on Robert’s Rules should also know that there may also be articles which relate to other articles. For instance let us look at Article 8 of the Societies Act.

Lions Club’s response to Newspaper report





The Lions Club of Kota Kinabalu Host claims it responded within 24 hours upon receiving a show cause letter from the Registrar of Societies on issues it believes “were purely administrative and do not warrant deregistration”

My comment: Why would The Lions Club of Kota Kinabalu Host respond within 24 hours when the matter is of such grave importance?

Should the matter not have been discussed at a BOD meeting or even at an EGM where all members’ opinions had been sought?

Extracts of relevant sections of Societies Act




2 (A) Registered societies to act in fulfillment of the Constitution
The registrar may cancel the registration of the society after giving the society an opportunity to make representations to him.

My comments: The Lions Club of Kota Kinabalu Host (Name applies only as from November 2016 . Prior to this date the name was not registered with ROS) was served with a notice under section 13 (2) of the Societies Act.

Societies Act and clubs




One of the few things that I had asked the ROS is the reason for my expulsion from the club. The ROS is obliged to seek a reasonable explanation from the club failing which I would be reinstated as a member.

Norman Lie Chin Man's 10 page report presented to the Board of Directors clearly shows that there is no acceptable reason for me to be expelled. You may read the 10 page report by clicking here:

Lions Club gets show cause letter from ROS

The above photo is an article in the Daily Express dated 11.1.2018 on the Lions Club of Kota Kinabalu Host.

The two points in the letter from ROS under section 13 (2) to the club are:
The club intentionally violated the provisions of the registered law of the establishments;
1. by failing to comply with the requirements of the provisions in making the selection or appointment of the Club's committee during a general meeting.
2.by having appointed a committee where it is not provided for in any Article content in the Club's Constitution.

Response to a comment on FB by Marcia Hong

In response to a comment by a Face Book friend, Marcia Hong said that she was an invited guest at the board meeting where she had blurted out some words.

Now, I went through the minutes as I have a little time as I think that this has gone far enough and we should leave it to ROS for its investigation as I had intended.

Is Lions Club International a Franchisor?



When I did not get any response from my club members I decided to write to LCI. I was told by one Past President from my club that LCI will not take any action as it is similar to a franchisor.

Another past president from another club was very cocky (or so I thought) and said that he was sure LCI will not interfere in local affairs.

The two faced Lion's Club of Kota Kinabalu









My former club must be the only club in the world with two names i.e Lions club of Kota Kinabalu and Lions Club of Kota Kinabalu Host.
I have now been informed that the statement attached to my blog post earlier this morning was never presented at an AGM but was presented to the Past Presidents Council.

The above two statements in 2012 apparently were what was presented at the AGM. I won't know if it was actually presented as I was not a member. Apparently according to Marcia Hong they had convinced Bukit Aman police that this was presented at the AGM (if that was true) and as such there was no misappropriation of funds.
