A LinkedIn post and my comments and responses


 


Here are extracts from a post on LinkedIn I commented on.

But the bank manager didn’t like it. He followed me outside to my car to tell me:

“Because you are not a member, you can’t dialogue with our customers. If you do, you can’t come back.”

At that moment, I had a choice:

i.                    React with racket energy—get defensive, blame, or fight back.

ii.                  Stay in integrity, engage for clarity, and be present to the possibility of something bigger.

Locus Standi (legal standing)


What prompted me to write my post on Public Interest Litigation last week?

I went to Registry of Societies (ROS) in December 2016 which is two years after the verdict on Locus Standi in 2014. (You may read about the 2014 ruling on Locus Standi here.)

One of the first questions asked by the officer at ROS is if I am a member of Lions Club of Kota Kinabalu Host to which I answered yes. I was asked to prove that I am a member. I asked as to whether I can make a complaint if I was not a member and the short answer was, No!

Public Interest Litigation


A recent ruling in Kuala Lumpur (in 2014), has simplified the test for legal standing (locus standi) in Malaysian public interest litigation cases. The new test developed by the Federal Court means a person will have legal standing to bring a case before the Court if they have at least a genuine interest in an issue of public importance. The new test removes the requirement that the litigant must show he has had his rights affected by the issue before the Court.

Crime and Locus Standi



If I know that a Crime has been committed by Lions Club of Kota kinabalu Host can I report it to the police? In other words do I have locus standi?

Well, assuming you witness a shooting incident where your neighbor is shot dead are you allowed to report to the police? According to a learned friend of mine you not only have the right to report but you are duty bound as a good citizen to report a crime.
