How the police investigation office failed in its duty



There were two major matters I had complained about:


1.       Misappropriation of funds which tantamount to criminal breach of trust
2.       Manipulation of minutes



1.       Misappropriation of funds

i.                     A bank account was opened in Alliance bank by 4 people whom I understand to be
a.       Arabi Wazani
b.      Joseph Chai
c.       CC Pung and
d.      Tan Sing Ben

The above account – No. 101960010096567- was opened in the name Lions Club of Kota Kinabalu Host which name was not registered with ROS.

The first question to have been asked is as to how a bank account was able to be opened in a name that is not registered with ROS or any other body.

I understand that it was made possible by Joseph Chai who was the former officer in Sabah bank which changed its name to Alliance Bank.

My emails to Bank Negara and Alliance bank, as to how a club could open an account without its name being registered with ROS, ended with the bank saying that this is confidential information. 

Did the police find out how a bank account was opened without its name being registered?
Was Joseph Chai reprimanded? 

Does opening a bank account in a club/society in a name not registered with ROS not open the flood gates for future abuse?

ii.                   Why was this account opened in the first place?
iii.                  Who are the members who are aware of this account?

The answers to the above questions which I had explained to the Investigating officer and can be easily verified from records are:


a.       The account was opened to siphon off excess project money and donations into this account for use by a few of the past presidents who were privy to this bank account.

If there were no mischievous intention then all Directors and members should be aware of this account.

The investigation officer should therefore have summoned some of the past presidents and members to find out if indeed there were those who are in the dark about this account. I believe not more than 10 past presidents are aware of this ‘secret’ bank account.


iv.                 A statement for this account showing balance brought forward, amount banked in from water project account less payment for air conditioners was given to the police department.


a.       Did the investigating officer understand this statement?
b.      Could there have been other receipts and payments not disclosed in the statement?
Any receipt can easily be withdrawn and not disclosed even to the privileged past presidents especially as this account is not audited.
c.       How is it possible, that receipts and payments of this bank account are not audited?
d.      Did the IO check the statement mentioned above to the bank statement received by her?


v.                   The same statement shows balance of fixed deposit of RM58,934.07


a.       Did the police ask as to how many members are aware of this fixed deposit?


vi.                 Should the police not question as to why this bank account was never reported to ROS?
If this bank account is indeed not a secret bank account how is that it is never mentioned in the minutes of meetings.

vii.                Why was I expelled for asking if there were any bank accounts not presented to directors?


viii.                     Did the police find out why the accounting records have not been checked by the District Governors or Past District Governors despite being directed by Lions Club International? Could it be that they were warned by concerned parties that their club will also be dragged in for doing similar things – using club money for administrative expenses?

ix.                   Who has, since my disclosure of these secret bank accounts, seen the accounting records including bank statements, payment vouchers and invoices?
a.       I was expelled for asking for bank statements, were others afraid they too would be expelled if they asked for the accounts?
b.      Should the investigation officer have asked for the accounts?
